Parallel Import Disclosure & Customer Acknowledgement

Essence Emporium Fragrances is committed to transparency regarding the sourcing and sale of products offered on our website.

Certain products sold by Essence Emporium Fragrances may be parallel imports. By purchasing a product from our website, the customer acknowledges that they have read and understood this disclosure.

What Is a Parallel Import?

A parallel import is a genuine product that is lawfully obtained and imported through a supply channel that operates independently from the product owner's official or authorised local distributor.

In simple terms, a product may be manufactured for one market and then sourced through an independent supply chain and imported into another market.

A parallel import is not automatically a counterfeit product merely because it was not sourced from the brand owner's official South African distributor.

Important Product Differences

Because certain products may be parallel imports, customers acknowledge that products may differ from locally distributed versions in certain non-product aspects, including:

  • Outer packaging;

  • Labels and regulatory markings;

  • Language used on packaging;

  • Importer or distributor information;

  • Batch-code presentation;

  • Barcodes;

  • Stickers;

  • Packaging materials; or

  • Other market-specific presentation features.

Differences in packaging or presentation alone do not automatically mean that a product is counterfeit, defective or inauthentic.

Customer Responsibility Before Purchasing

Customers are encouraged to carefully review:

  • Product descriptions;

  • Product sizes and concentrations;

  • Fragrance notes;

  • Images and information provided;

  • This Parallel Import Disclosure;

  • Our Refund & Return Policy; and

  • Our Terms & Conditions

before completing a purchase.

By proceeding with an order, the customer confirms that they understand that certain products may be sourced through parallel import channels and that packaging may differ from products distributed through official local channels.

Authenticity and Product Concerns

If a customer believes that they have received an incorrect, damaged, defective or potentially inauthentic product, they must contact Essence Emporium Fragrances before disposing of, altering, refilling or materially changing the product.

We may reasonably request:

  • Proof of purchase;

  • The relevant order number;

  • Clear photographs or videos;

  • Details of the concern; and/or

  • Return of the product for inspection where appropriate.

Any authenticity or product-related complaint may be investigated before a resolution is determined.

No Automatic Right to a Refund Based Solely on Packaging Differences

A difference in packaging, labels, language, importer information or other market-specific presentation characteristics does not by itself establish that a product is counterfeit, defective or incorrectly supplied.

A refund request will therefore not automatically be approved solely because a customer identifies a difference between their product and a version sold through another country's or local authorised distribution channel.

Any legitimate statutory rights that apply to a defective, incorrect or unlawfully supplied product remain unaffected.

Product Integrity and Fraud Prevention

To protect customers and the business against fraudulent claims, product substitution and tampering, returned products may be inspected to verify:

  • Product identity;

  • Condition;

  • Evidence of tampering or refilling;

  • Evidence of product substitution;

  • Relevant identifying information; and

  • Whether the returned product corresponds with the product originally supplied.

Where there is reasonable evidence that a returned product has been substituted, materially altered, refilled, tampered with or is not the product originally supplied, the claim may be rejected to the extent permitted by applicable law.

Customer Acknowledgement

By placing an order with Essence Emporium Fragrances, the customer acknowledges that:

  1. Certain products sold by Essence Emporium Fragrances may be parallel imports.

  2. Parallel imports may be sourced independently from the brand owner's official local distribution channel.

  3. Packaging and market-specific presentation may differ from products distributed through official South African channels.

  4. Packaging differences alone do not automatically establish that a product is counterfeit or defective.

  5. Any complaint may require reasonable supporting information and, where appropriate, inspection of the product.

  6. Nothing in this disclosure removes or limits any consumer rights that cannot legally be excluded under applicable South African law.

Legal Rights

This disclosure is intended to provide customers with clear information before purchase.

Nothing in this Parallel Import Disclosure is intended to exclude, waive or limit any mandatory rights available to consumers under applicable South African law. Where this disclosure conflicts with a mandatory legal requirement, the applicable law will prevail.
