IMPORTANT LEGAL NOTICE

PLEASE READ BEFORE PURCHASING FROM ESSENCE EMPORIUM FRAGRANCES

By placing an order with Essence Emporium Fragrances, you confirm that you have read, understood and agreed to our Terms & Conditions, Parallel Import Disclosure, Authenticity Statement, Shipping Policy, and Refund & Return Policy.

PRODUCT INFORMATION & PARALLEL IMPORTS

Certain products sold by Essence Emporium Fragrances may be sourced through parallel import channels. These products are sourced independently of local authorised distributors and may differ from locally distributed products in:

  • Outer packaging;

  • Labels and regulatory markings;

  • Batch presentation;

  • Importer information;

  • Language on packaging; or

  • Other non-product presentation characteristics.

Packaging differences alone do not establish that a product is counterfeit, defective or inauthentic.

Customers acknowledge that they have been informed of this disclosure before purchasing.

FRAGRANCE EXPECTATIONS

Fragrance is subjective. Individual perceptions of scent, longevity and performance may vary depending on skin type, climate, storage, application and other personal factors.

A customer's personal dissatisfaction with a fragrance, including statements such as “I do not like the smell,” “it does not smell as expected,” or “it does not last as long as I expected,” does not automatically mean that the product is defective, incorrect or inauthentic.

PRODUCT INSPECTION & CLAIMS

Any claim relating to an incorrect, damaged, defective or allegedly inauthentic product may be subject to a reasonable investigation.

Essence Emporium Fragrances may require:

  • Proof of purchase;

  • The relevant order number;

  • Clear photographs or videos;

  • Additional information reasonably necessary to investigate the claim; and/or

  • Return of the product for inspection where appropriate.

No customer should dispose of, alter, refill or materially use a disputed product while an investigation is ongoing.

RETURNED PRODUCT VERIFICATION

Returned products may be inspected to verify their identity, condition and whether they correspond with the product originally supplied.

Where there is reasonable evidence of product substitution, tampering, refilling, misuse, material use, alteration or a return of a product that was not originally supplied, a return or discretionary refund may be refused to the extent permitted by applicable law.

NO AUTOMATIC REFUND

Submitting a complaint or return request does not automatically entitle a customer to an immediate refund.

Where legally permitted, refunds or replacements may only be processed after the relevant claim has been assessed and, where necessary, the product has been returned and inspected.

Approved refunds will be processed in accordance with our Refund & Return Policy and applicable South African law.

CUSTOMER ACKNOWLEDGEMENT

By completing a purchase, the customer acknowledges that they:

  1. Have reviewed the product information before ordering;

  2. Understand that certain products may be parallel imports;

  3. Understand that packaging may differ from locally distributed versions;

  4. Understand that scent preference and personal expectations are subjective;

  5. Agree to provide reasonable information required to investigate a legitimate claim;

  6. Agree not to substitute, tamper with or alter a product before returning it; and

  7. Understand that nothing in this notice removes any consumer rights that cannot legally be excluded under applicable South African law.

ESSENCE EMPORIUM FRAGRANCES RESERVES THE RIGHT TO PROTECT ITS BUSINESS AGAINST FRAUDULENT, FALSE OR DELIBERATELY MISLEADING CLAIMS WHILE CONTINUING TO HONOUR ALL LEGITIMATE CUSTOMER AND STATUTORY RIGHTS.
